The Michigan Health Endowment Fund and our affiliates (“Health Fund”, “we”, “us” or “our”) are committed to protecting the privacy of Personal Information you provide when you visit our website and all other websites, mobile sites, services, applications, platforms and tools where this Privacy Policy appears or is linked (collectively, the “Site”). This Privacy Policy explains the information we may collect during your visit to our Site and how we use, share, and store that information.

Who We Are
The Health Fund is a philanthropic foundation that works to improve the health of Michigan residents while reducing the cost of health care, with an emphasis on children and older adults. The Health Fund provides financial support, expertise, technical assistance, and partnership to organizations across the state of Michigan who are working to improve the health of the communities they serve.
Purpose of this Privacy Policy
This Privacy Policy aims to give you information on how we collect and process your Personal Data through your use of our Site, including any data you may provide which includes but is not limited to newsletter sign-up or applying for funding.
It is important that you read this Privacy Policy together with any other Privacy Policy or fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data about you so that you are fully aware of how and why we are using your data. This Privacy Policy supplements our other policies and is not intended to override them.

This Site may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. 2. WHAT INFORMATION WE COLLECT
Personal Information, or Personal Data, means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.
We or our service providers may collect, use, store and transfer different kinds of Personal Data about you via our Site or in the course of providing services to you which we have grouped together as follows:
- Identity Data includes first name, last name, username or similar identifier, date of birth.
- Contact Data includes street address, city, state, zip, email address and telephone numbers.
- Professional or Employment-Related Data includes your company name, your job title, and your company contact information.
- Characteristics of Protected Classifications includes racial/ethnic background, and gender identity.
- Financial Data through our grants management system partner, Fluxx, which includes payment card details, account numbers, and expiration dates.
- Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access the Site, and information about how you use our Site, products and services.
- Outreach and Communications Data includes your preferences in receiving communications (for example: newsletter, annual report, and other email communications you elect to receive) from us and our third parties and your communication preferences.
- Service Use Data includes information about how you use our Site, products, and services
- Employment History includes current or past job history or performance evaluations and limited data (start/end dates, title and employer name) on previous employment.
Privacy
The Health Fund collects and uses Personal Information such as: name, address, phone number, and email address when an individual voluntarily provides it to us. In addition, the Health Fund keeps a secure record of grant and grant application history. This information is kept on file for IRS purposes and is also used by the Health Fund to evaluate various aspects of our work.

3. HOW WE COLLECT YOUR INFORMATION
We primarily collect your Personal Data when you provide it to us voluntarily in person, by telephone, text, or email, and/or through our web-based platforms used in the administration of Health Fund activities. This includes Personal Data you provide when you:
- Apply for grants, technical assistance, professional development, or other capacity building support from the Health Fund;
- Apply for employment or connect with us for a collaboration or other partnership opportunity;
- Create an account on our grants management platform;
- Subscribe to our services or publications;
- Request outreach communications (newsletter, annual report, email list) to be sent to you;
- Complete a survey; or
- Give us feedback.
We may also collect information:
- From publicly accessible sources;
- Directly from third parties;
- From a third party with your consent;
- From cookies on our Site; and
- Via our IT systems, including automated monitoring of our Site and other technical systems, such as our computer networks and connections, communications systems, and email and instant messaging systems.
Aggregate and Non-Personal Information
The Health Fund may use the Personal Information you provide in an aggregate form. Such aggregated information is not considered Personal Information for purposes of this Privacy Policy, and we may use it for any purpose, including but not limited to, for our internal program, research and general marketing purposes, such as generating statistics, developing plans for promoting our services and to better understand the audience attending our programs.
We may also collect certain non-personal information about your use of the Site (e.g., to determine which pages of our Site are most popular and to improve use of the Site). We may collect IP addresses to analyze trends, administer our Site, track traffic patterns, and gather demographic information for aggregate use. We may share this aggregated non-personal information with our affiliates, licensees and partners, and may post analyses and statistics based on the aggregated data on the Site or use the data for research or promotional purposes relating to our mission. We do not use IP addresses in combination with your Personal Information without your prior consent.
Cookies
We also may use “cookies” to collect information about visitors to our Site. A “cookie” is a small text file that a website places on your computer’s hard drive to make it easier to use certain website functions or to collect information about your activities on the website. How We Respond to “Do Not Track” Signals
Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Outreach Communications
We have a legitimate interest in processing your Personal Information for promotional purposes. This means we do not usually need your consent to send you outreach communications like our newsletter, publications, and email list. However, where consent is needed, we will ask for this consent separately and clearly.
We strive to provide you with choices regarding certain Personal Data uses, particularly around outreach communications. You can manage outreach communications we provide to you by opting out.

5. DISCLOSURES OF YOUR INFORMATION
The Health Fund will not trade, sell, or otherwise disclose your Personal Data to outside parties. This does not include third parties who assist us in operating our Site, operating the Health Fund, or providing services to you at the request of the Health Fund, so long as those parties agree to keep this information confidential. Those trusted third partners may:
- Provide you and members with various services
- Provide database maintenance and security
- Help up manage transactions and events
- Help us process and fulfill requests, applications, and other forms.
We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect our or others’ rights, property, or safety.
Disclosure in the Event of Transfer of Service Providers
If we are involved in a transition of service to another provider, then your Personal Data may be transferred as part of such a transaction, as permitted by law and/or contract. By providing your Personal Information to us, you consent to such a transfer.
6. DATA SECURITY
We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used, or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a need to know. They will only process your Personal Data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

CHILDREN’S INFORMATION
Health Fund does not knowingly gather any Personal Information from children under the age of 17. You must be 17 years of age or older to access the site. Health Fund has no interest in collecting information from children under the age of 17
8. HOW TO EFFECTUATE YOUR PRIVACY RIGHTS
We provide you with a variety of ways to control the personal information we hold about you, including choices on how we use that information.
- Account Settings. You may access, modify or delete your account in our grants portal through Fluxx. You may update your email subscriptions and access to email newsletters by visiting your personal account settings through the unsubscribe link shared in our email communications.
- Communication Preferences. You can unsubscribe from email, mail, telephone and text message communications from us. To do so, call us at 517-374-0031 or email us at [email protected] or use the unsubscribe link shared in our email communications.
- For email requests, it may take up to ten days for us to process your requests. For requests related to telephone calls, text messages, mobile service notifications it may take up to 30 days. If you adjust your postal mail preferences, it may take six to ten weeks before you stop receiving mail because postal mailings are prepared many weeks in advance.
- Regardless of your marketing communication preferences, we may still contact you for transactional or informational purposes, such as customer service, reminder or service notices, recalls, or information regarding your subscription or order(s).
- Opt-Out of Targeted Advertising. We may use your information for targeted advertising purposes, as described above. You may opt out of such processing by emailing us at [email protected].
- Cookie Controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our websites. If you choose to delete cookies, settings and preferences controlled by those cookies, including third party targeted advertising preferences, may be deleted and may need to be recreated. - Global Privacy Settings. - Verification & Authorized Agents. You may use an authorized agent to submit verifiable consumer requests on your behalf. An authorized agent is a natural person or a business entity that you have authorized to act on your behalf. We will take reasonable steps to verify your identity and requests, including by verifying your account information, residency or the email address you provide. If you are an authorized agent submitting a request on behalf of another individual, we may require proof of your written authorization before processing the request. We may deny a request from an authorized agent that does not submit proper verification proof.
- Exempt Information. Certain information may be exempt from such requests under applicable law such as information we retain for legal compliance and to secure our Services. We may need certain information in order to provide the Products or Services to you; if you ask us to delete it, you may no longer be able to obtain the Products or use the Services.
- Non-Discrimination. You will not receive discriminatory treatment by use for the exercise of any of your privacy rights described herein.
9. OTHER IMPORTANT LEGAL TERMS
The terms in this Privacy Policy and in our Terms of Use have legal importance and may be used by us in a legal proceeding, including to restrict certain claims by you or to limit your rights.
Specifically:
- Limitation of Liability. To the maximum extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, will we or our subsidiaries, parent companies or affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from our use of personal information, even if we are advised beforehand of the possibility of such damages, and the maximum amount of damages for which we will be liable under this agreement will be the greater of the fees you paid for any product in connection with which you provided your personal information, or $100 (because some jurisdictions do not allow the exclusion or limitation of certain categories of damages, the above limitation may not apply to you. In such jurisdictions, our liability and the liability of our subsidiaries, parent companies and affiliates, is limited to the fullest extent permitted by such law.). You specifically acknowledge and agree that we are not liable for any defamatory, threatening, offensive or illegal conduct of any user of our services.
- Indemnification. You agree to indemnify and hold harmless us, our affiliates, and each of our and their respective directors, officers, managers, employees, shareholders, agents, representatives and licensors, from and against any and all losses, expenses, damages and costs, including reasonable attorneys’ fees, that arise out of your provision of any inaccurate or unauthorized Personal Information to us or your violation of this Agreement or any rights of another. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this section. In such event, you agree to provide us with such cooperation as is reasonably requested by us.
- Choice of Law. This Agreement will be governed by and construed in accordance with the laws of the State of Michigan without giving effect to any principles of conflicts of law.
- Statute of Limitations for All Claims. To the extent permitted by applicable law, you agree that regardless of any statute or law to the contrary or providing for a longer period, any claim or cause of action that you may have arising out of or related to use of the Services or this Agreement must be filed by you within one year after such claim or cause of action arose or be forever barred.
Waiver of Class Action Claims
This is an important section that limits your right to bring a class action against us.
You and Health Fund agree that each party may bring disputes against the other party only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, including, without limitation, a federal or state class action lawsuit. However, nothing in this section limits your right or Health Fund’s right to bring a lawsuit against each other as an individual plaintiff. This provision applies to the maximum extent permitted by applicable law to all claims that arise under, in connection with, or relate to this Privacy Policy or the Personal Information you provide to us (whether your own or any other Personal Information you provide), Personal Information that is automatically collected by us and/or obtained by us from third parties; that arose under, in connection with, or relate to any previous privacy policy in effect or that otherwise arose before these terms went into effect; or that may arise in connection with or after or otherwise relate to your Personal Information (or any other Personal Information you provide to us) after termination of any business relationship we may have with you, including cancellation or deletion of your accounts if applicable.
